Access to and use of this Website and the products and services available through this Website (collectively, the "Services") are subject to the following terms, conditions and notices (the "Terms of Service"). Using the Service, you are agreeing to all of the Terms of Service, which may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms of Service.

Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of our Website.

This Website also contains links to other websites, which are not operated by Vesper (the "Linked Sites"). She’s Fabulous has no control over the Linked Sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. Your use of the Linked Sites will be subject to the terms of use and service contained within each such site.

Terms of Sale:

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are limited to Northern Ireland and subject to any delays resulting from postal delays or force majeure for which we will not be responsible.

In order to contract with She’s Fabulous you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. She’s Fabulous retains the right to refuse any request made by you. If your order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be She’s Fabulous or may in some cases be a third party. Where a contract is made with a third party She’s Fabulous is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.


Made to order dresses/ products

A Booking Payment of 50% or £100 is to be paid on all orders on the day the order is made; No refunds can be given in the event of cancellation of any part of the order.
The remaining part of the account must be paid for when the goods arrive in store, unless an alternative time span has been agreed with She’s Fabulous.
No goods may be taken before all of the order has been paid for in full.
Once you have placed the order a contract has been made and you become liable for the full costs of items ordered. All sales are final.
In the event of cancellation you will remain liable for the full cost of items ordered. Deposits are non-refundable and non-transferable after 7 days.

Gowns/dresses are made to order but not made to measure. UK / US standard sizes apply on all items. It is probable alterations will be needed. If you have alterations done then these are at extra cost to yourself. All dresses are ordered to the largest measurement of the bride or maid to allow for variations in girls body shapes, this will mean that alterations will most likely be required. Bridesmaid / Formal size charts are different for every designer so you might find that your size is not your usual high street size.
She’s Fabulous do not offer alteration work, but we do have a list of seamstresses from all over Northern Ireland/ Ireland, we are not responsible or liable for any work carried out by the seamstress this is between you and them.
No alterations can be made until goods have been paid for in full.
She’s Fabulous cannot accept responsibility for a dress or gown no longer fitting due to weight gain/loss, pregnancy or other circumstances beyond our control.
Surcharges will be made for changes to the sample e.g. adding or removing of sleeves, larger sizes over the standard stocked sizes if required, waist to floor measurements. This will be added to the balance of the account.
When ordering gowns and dresses the person placing the order takes full responsibility for the size ordered and any measurements taken, for changes to the sample such as waist to floor measurement. Bespoke Brides will advise on sizing and measuring but cannot accept responsibility if the size of measurements are incorrect. If you decide to order a dress or gown that is not what we would recommend due to planned weight loss we will not accept any liability for the dress/gown fitting when arriving.
Slight variations in fabric colour, texture, and trim can be possible within a tolerance these are beyond our control as all material is dyed from scratch for each dress.
All garments must be inspected on picking up as we cannot accept responsibility for the condition of any item after it has left our premises.
Sale goods are sold as seen and no refunds will be given.
Ownership of merchandise remains with She’s Fabulous until payment has been made in full, including any extra charges included on the invoice.
Although every effort will be made to receive delivery of your order on time, She’s Fabulous cannot be held responsible or liable for suppliers not delivering goods on time. Allow 5 months for made to order.
She’s Fabulous accept no responsibility or liability for the suitability of a gown or any other item for use outside its intended purpose.
She’s Fabulous must be given the opportunity to inspect any garment or item which is subject to a complaint and given reasonable chance to rectifying the problem.
This contract is subject to the law of Northern Ireland,England and Wales and all disputes arising out of this contract shall be subject to the jurisdiction of the court of Northern Ireland , England and Wales. This contract is legally binding and enforceable on the first part payment received, this does not affect your statutory rights


1.Intellectual Property, Software and Content

The intellectual property rights in all software and content made available to you on or through this Website remains the property of She’s Fabulous or its licensors and are protected by copyright laws and treaties around the world. All such rights are reserved by She’s Fabulous and its licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.

You shall not modify, translate, reverse engineer, decompile, disassemble or create derivative works based on any software or accompanying documentation supplied by She’s Fabulous or its licensors.

2.Prohibitions

You must not misuse this Website. You will not: commit or encourage a criminal offence; transmit or distribute a virus, trojan, worm, logic bomb or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person's proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as "spam"; or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website. Breaching this provision would constitute a criminal offence under the Computer Misuse Act 1990. She’s Fabulous will report any such breach to the relevant law enforcement authorities and disclose your identity to them.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.

P9 Commerce Limited (“She’s Fabulous”) is totally committed to protecting the privacy of our site visitors and customers. The She’s Fabulous team members are customers themselves of other Internet sites and fully appreciate and respect the importance of privacy on the Internet. We will not disclose information about our customers to third parties except where it is part of providing a service to you - e.g. arranging for a product to be sent to you, carrying out credit and other security checks and for the purposes of customer research and profiling or where we have your express permission to do so.

We will not sell your name, address, e-mail address, credit card information or personal information to any third party without your permission, but we cannot be responsible or held liable for the actions of third party sites from which you may have linked or been directed to the She’s Fabulous website.

All customer date is processed in accordance with local law.

Payment Security

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.


Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

All prices are inclusive of VAT within the EU. Prices quoted on shesfabulous.co.uk do not include VAT or sales taxes outside of the EU. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.

Not all designs/products are available to purchase outside of the UK. She’s Fabulous will inform you if any part of your order falls into this category.

Payment

Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.

Payment in store
Payments in store are final and can only be exchanged within 7 days of purchase. Purchases made online can be returned within 14 days, apart from sale goods. Dresses hired are final sales. An unused hire dress may not be refunded as the dress has been absent from our store and the charge will still apply.

Discount Codes

Account discount codes - Discount codes may from time to time be offered to account holders; such codes may only be applied to purchases made through the account in respect of which the discount code was offered and registered. Only One discount code can be applied per transaction.
Promotional discount codes - We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made though this Website. Only one promotional discount code can be applied per transaction.
Entire Agreement

1.Invalidity

If any part of the Terms of Service is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Service will not be affected all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.

2.Complaints

We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise, please let us know if you have any complaints or comments.

3.Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

4.Governing Law and Jurisdiction

These terms and conditions are to be construed in accordance with the laws of England and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the English courts.

The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and She’s Fabulous. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of She’s Fabulous.
